File early, because the filing timeline is longer than your launch timeline.\n\n## The short version\n\n- **Selling is possible without a mark. Defending is not.** Anyone can add offers to your listing and your options are limited until you are registered.\n- **Registration unlocks the tools you were planning to use.** A+ content, brand storefronts, Sponsored Brands and Brand Analytics all sit behind Brand Registry.\n- **The filing clock is the long pole.** Start it before sourcing finishes, not after the container ships.\n- **A mark is per jurisdiction.** A US registration does nothing for you in the EU marketplaces.\n- **Buyers of Amazon businesses check this first.** Without a registered mark you own a listing, not an asset.\n\n## I have been on the buying side of this\n\nBefore Flapen I ran data and technology at BRANDED and at Moonshot Brands, two large Amazon aggregators, which means I spent a long stretch looking at seller businesses as things to purchase rather than things to build.\n\nEvery diligence checklist I saw opened the same way: show me the registration certificate, the classes, the jurisdictions and the ownership entity. A brand with a clean mark was a company. A brand without one was a set of listings, an account, and a supplier relationship anybody could copy. If you are building something you intend to own, file first and use the early-access route so you are not waiting on a registry to start selling.\n\nThe mistake is the middle position: deciding to file eventually, launching without a mark, and discovering in month four that the listing you have built is the one you cannot defend.\n\n## What registration actually buys you\n\n**Enforcement.** Reporting infringement and removing counterfeit or hijacked offers gets faster and more reliable, because the tools require a registered brand.\n\n**Content.** A+ content, brand stores and Sponsored Brands are conversion and traffic tools. Every one of them is gated behind Brand Registry.\n\n**Data.** Brand Analytics search query data is first party evidence of what buyers search and where the clicks go in your category. It is one of the better inputs available and you cannot see it unregistered.\n\n**Ownership.** The mark is the thing the business is built on. Packaging, listing copy and creative all point at a name, and if the name is not yours the investment points at nothing.\n\n## Sequencing it against the rest of the launch\n\nPut the filing on the same timeline as sourcing rather than after it. The order that works: choose the name once the niche is decided, run a clearance check for conflicts in your classes, file, then continue sourcing while the application processes. Packaging and creative are produced with the name already committed, so nothing gets reprinted.\n\nA full brand launch runs about seven months from decision to a properly launched product, and a filing started at the beginning of that window is rarely the thing holding you up. A filing started at the end almost always is.\n\nOne more sequencing note for anyone planning multiple marketplaces. Registration is per jurisdiction, so plan the filings for the countries you intend to sell in before you commit freight to those countries. We run all 23 Amazon marketplaces, and the trademark position by country is one of the first things we map on an expansion plan for exactly this reason.\n\n## What most agencies will not tell you\n\nTrademark filing is not included in an agency's monthly fee, at us or anywhere else, and it should not be. It is a legal filing with a government office, and you want it in your own entity's name rather than an agency's.\n\nCheck that. Ask who the applicant is on the filing and who holds the Brand Registry account. Both should be you. An agency should hold access through granted user permissions on your account, revocable whenever you decide, and if a proposal has your brand registered under anyone else's entity, that is the end of the conversation.
