Enrollment is a finite three-step project, trademark, registry, brand tools. Protection is continuous watching of listings and hijackers. Buy the second.

Protection is continuous: watching listings, hijackers, and unauthorised sellers, and closing the supply-side leak that created them. Buy the second, and treat the first as a short project inside it. ## If you are searching for this, one of three things happened Either you are launching and someone told you enrollment unlocks A+ content and storefronts, or another seller appeared on your listing, or your product is being sold by an account you have never heard of at a price you did not set. The first is a scheduling problem. The second and third are supply chain problems wearing a marketplace costume, and that distinction changes who you should hire. Enforcement removes a listing. It does not answer how the units got out. If nobody works the second question, the same listing reappears under a new seller name and you buy the same service again next quarter. ## Score any provider on these seven criteria Rate each from one to five, multiply by the weight, total it. Below 55 out of 110, keep looking. | Criterion | Weight | What a five looks like |
| --- | --- | --- | | Trademark path clarity | 4 | Tells you which jurisdiction to file in for the marketplaces you actually sell in, and prices the filing as a pass-through cost | | Marketplace coverage | 4 | Can operate across every marketplace you sell in, not only your home one | | Enforcement response time | 3 | A stated turnaround and a named person, not a ticket queue | | Supply-side capability | 3 | Can trace units back toward the source and change the supplier arrangement | | Evidence and reporting | 3 | Written weekly record of what was reported, what came down, and what came back | | Access and IP terms | 3 | Works through revocable permissions on your account, deliverables become your IP | | Exit terms | 2 | Short notice, and you keep the registry enrollment, assets, and a written handover | The weighting reflects where the money is. Filing and coverage decide whether protection is even possible. Response time decides how much revenue leaks while you wait. ## The sequence, in the right order 1. **Trademark first.** Registry enrollment depends on it, and the filing is a legal cost of yours rather than part of an agency fee. Any provider bundling it invisibly is worth questioning. 2. **Enroll, then inventory your rights.** Know which marketplaces you are covered in and which you are not, because that map is your enforcement footprint. 3. **Switch on the brand tools.** Enrollment is also what unlocks A+ content and storefront features, so schedule the creative work to start the week enrollment completes rather than the month after. 4. **Set a watch cadence.** Someone checks buy box ownership, seller count, and listing content on a fixed schedule. Weekly is enough for most catalogs. 5. **Close the leak.** Trace where unauthorised units originate, then fix it at the source: minimum order controls, distribution terms, and packaging or serialization choices made with the factory. Step five is the one most protection services skip, because it requires being present on the manufacturing side rather than the marketplace side. ## The part that needs a factory relationship Our sourcing runs from an in-house studio in Guangzhou, with frameworks built across 500+ brands, and that is the capability I would tell you to test hardest in any provider. Hijacked listings and gray-market units are usually a symptom of overproduction, an unmanaged second shift, or a distributor selling outside their territory. Those are conversations with people who make things, in their language and time zone. A provider who can only file reports on Amazon is doing the visible half of the job. Ask directly: have you ever traced counterfeit or unauthorised units back to a source, and what did you change to stop it. The answer separates a service from a subscription. ## What a protection package should and should not promise Reasonable promises: enrollment handled, a watch schedule with written evidence, infringements reported promptly with follow-up, listing content restored when it is altered, and a supply-side review. Unreasonable promises: guaranteed permanent removal of every counterfeit, a fixed timeline for outcomes that Amazon controls, or any claim about influencing a decision at Amazon. We work across all 23 Amazon marketplaces with everything done in-house and no subcontracting, on month-to-month terms with 30 days' notice. That last detail matters more than it looks in a protection context, because a provider who has to be kept on retainer to maintain access has an incentive you do not want. ## What most agencies will not tell you Brand protection is one of the easiest services to sell and one of the hardest to measure. A monthly report listing infringements reported feels like progress even when the same three sellers cycle back under new names every six weeks. Ask for the recurrence number, not the reporting number: how many of the listings taken down last quarter came back. The second thing: enrollment itself is a few hours of administration once the trademark exists. Charging a large one-off fee for it is common. If a proposal is priced mostly around enrollment rather than around the continuing watch and the supply-side work, you are paying a premium for the finite half of the job. ## Related answers - [Outsourced Brand Registry support for Amazon](https://flapen.com/blog/outsourced-brand-registry-support-for-amazon) - [White-glove Amazon brand protection service](https://flapen.com/blog/white-glove-amazon-brand-protection-service) - [Amazon Brand Registry support expectations](https://flapen.com/blog/amazon-brand-registry-support-expectations) - [Amazon store setup and A+ content services](https://flapen.com/blog/amazon-store-setup-and-a-content-services) - [Build vs buy for your Amazon channel: the complete guide](https://flapen.com/blog/build-vs-buy) Registry, enforcement, and the supply-side work sit in one flat fee at [Flapen](https://flapen.com/amazon-consulting). ## Keep learning - [Compare Amazon business models](https://flapen.com/guides/business-models) - [Value your Amazon business](https://flapen.com/tools/business-value-calculator) ## **Frequently Asked Questions**Do I need a registered trademark or is a pending application enough? Can an agency file the trademark for me?How do I stop unauthorised sellers permanently? What should the weekly protection report contain?Does Brand Registry help my listings rank? ## About the Author![Joel Turcotte Gaucher](https://flapen.com/_vercel/image?url=%2Fimages%2Fteam%2Fjoel-turcotte-gaucher-avatar.webp&w=64&q=100) [**Joel Turcotte Gaucher**](https://flapen.com/blog/author/joel-turcotte-gaucher) Founder & CEO at Flapen Joel has spent 10 years in Amazon and ecommerce, running data and technology at BRANDED and Moonshot Brands, two of the largest Amazon aggregators, where he audited and scaled 60+ acquired brands.
