Brand Registry needs a registered or pending mark, filings are territorial, and the expensive failures are all timing failures: launching unprotected, discovering your name cannot be cleared, or expanding into Europe or the Gulf with no local filing. Good guidance is mostly about sequence, not paperwork. ## The short version - **Sequence is the product.** The enrollment forms are trivial once the mark exists. What you are buying is the discipline to do things in order. - **Pending is usually enough.** In many territories a filed application already opens Brand Registry, so early filing pays twice. - **Every region is a separate decision.** US, EU, UK, and UAE marks are independent filings with independent clocks. - **Monitoring is half the value.** Enrollment without violation monitoring is a certificate in a drawer. - **The best advice is sometimes a no.** An advisor with stop criteria will save you more than one with a filing checklist. ## The five failures, ranked by what they cost 1. **Launching before filing.** The most expensive, because unwinding it means a rebrand: new packaging, new listings, lost review history, and months of momentum. Filing costs a few hundred dollars per territory and some patience. The asymmetry could not be clearer, and people still get it backwards every week. 2. **Falling in love with a name that cannot be cleared.** Descriptive names and near-collisions with existing marks fail at the trademark office after the logo, the packaging, and sometimes the first purchase order already exist. Clearance searching comes before attachment, and certainly before inventory. 3. **Expanding unprotected.** The geographic version of failure one. A US mark protects amazon.com and nothing else. The brand that launches on amazon.de or amazon.ae with no local filing is exposed in its newest, most fragile market. File for the territory when the expansion decision is made, not when the container ships, because applications take months. 4. **Treating enrollment as the finish line.** Registry unlocked, nobody watching. Counterfeits, listing hijacks, and image swaps accumulate quietly until a peak-season week makes them expensive. Monitoring and violation response are the recurring work, and they need a named owner. 5. **Nobody owning the whole thread.** The attorney thinks the agency tracks violations, the agency thinks the attorney handles renewals, and the founder assumes both. Cheapest to prevent, miserable to discover. One person, agency-side or client-side, holds the calendar: filings, renewals, marketplaces, monitoring. ## The stop question The most useful thing a trademark advisor can tell you is when to stop. We run our product decisions on explicit kill criteria, rating trend, return rate, conversion rate, and acquisition-cost trajectory over a defined window, because hope is not an operating system. Naming decisions deserve the same structure, agreed before money is spent: what clearance result means we rename now, what opposition risk means we stop, which markets are no-gos for this name. Ask any advisor, agency or attorney, what would make them tell you to stop and start over. A filing service will not have an answer. Guidance will. The stakes are concrete: a single product launch commits **$8,000 to $15,000** in capital. Renaming after that money is spent means repurchasing packaging and rebuilding a listing's history from zero. That is not where the value is. The parts worth paying for are judgment and operations: clearance strategy, filing sequence across the territories you will actually sell in, and the standing monitoring that catches a hijacked buy box on a Tuesday rather than in a quarterly review. When you compare providers, make each one separate the paperwork from the judgment in their own proposal. The ones who resist the separation are charging judgment prices for paperwork. Also, filing costs are pass-through. Territory fees and attorney charges vary by jurisdiction, and none of it should carry an agency markup.
